When a tool is widely accessible, feels authoritative, and is fueled by sensitive personal data, the line between “helpful information” and “health decision-making” blurs fast. And the public rarely knows where regulation ends and responsibility begins.

The FDA’s new guidance clarifies when certain tools fall outside the scope of medical device oversight. This includes some “general wellness” features, positioned as low-risk lifestyle support, and certain clinical decision support functions, depending on how the software is intended to be used and whether clinicians can independently review the basis of the recommendations.
The net effect is that more AI-enabled experiences can reach the market quickly, especially when they are framed as “support” rather than “diagnosis and treatment.”
Now add ChatGPT Health. OpenAI states Health is designed to support, not replace, medical care, and that Health conversations are not used to train their foundation models. OpenAI also published a Health-specific privacy notice and guidance on connecting medical records in the U.S. at launch.
